Cutline Terms of Use

1. Agreement

These Terms of Use (“Terms”) govern your access to and use of Cutline, including the Cutline iOS application, the website at cutline.nexpher.com, and related licensing services (together, “Cutline”). Cutline is provided by Nexpher (“we”, “us”, or “our”).

By creating a Nexpher account, downloading Cutline, purchasing a subscription, or using Cutline, you agree to these Terms. If you do not agree, do not use Cutline.

2. Account

Cutline requires a Nexpher account. You are responsible for maintaining the security of your credentials and for activity under your account. You must provide accurate account information and promptly update it when it changes.

3. Subscription and license

Cutline is offered as a paid subscription (and, in limited cases, complimentary access granted by Nexpher). A paid subscription may be purchased:

• App Store (Apple): billed by Apple under Apple’s terms and payment methods. Manage, cancel, or request refunds through your Apple ID / App Store subscriptions.
• Web (Stripe): billed by Nexpher through Stripe on cutline.nexpher.com. Manage payment methods and cancellation through the Cutline billing portal linked from your license page.

Your subscription grants a limited, personal, non-exclusive, non-transferable license to use Cutline for your own editorial and photography workflows, subject to these Terms and any plan limits (including device seat limits). Unless stated otherwise, the default plan allows use on up to two activated devices.

Only one active Cutline entitlement applies per Nexpher account. You may not stack simultaneous App Store and web subscriptions for the same account to exceed plan limits.

4. Billing, renewals, and cancellation

Subscriptions renew automatically until canceled. Prices, taxes, and renewal timing are shown at checkout (App Store or Stripe). Cancel before the renewal date to avoid the next charge.

For App Store purchases, Apple’s refund policies apply. For web purchases, contact [email protected] for billing questions. Complimentary access may be modified or revoked by Nexpher at any time.

5. Your content

You retain ownership of photos, captions, metadata, and other content you import or create in Cutline (“Your Content”). You are responsible for having the rights to use Your Content and for complying with applicable laws, including privacy and publicity rights of people depicted in your photos.

Cutline processes Your Content on your devices and through services you connect (for example FTP destinations you configure). We do not claim ownership of Your Content.

6. Acceptable use

You agree not to:

• Reverse engineer, resell, or redistribute Cutline except as allowed by law
• Share your account or circumvent device seat or license checks
• Use Cutline for unlawful, infringing, or abusive activity
• Interfere with Cutline’s security, licensing, or availability

7. Privacy

Our handling of personal data is described in the Nexpher Privacy Policy. Cutline licensing is tied to your Nexpher account identity.

8. Disclaimer and limitation of liability

Cutline is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by law, Nexpher’s total liability arising out of or related to Cutline will not exceed the amounts you paid to Nexpher for Cutline in the twelve (12) months before the claim (or, for App Store purchases, the amount Apple remitted attributable to your Cutline subscription for that period, if applicable).

9. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of Cutline after changes means you accept the updated Terms. Material changes to paid subscriptions will be communicated as required by applicable law or platform rules.
